304. Letter to Dean

still no sign of reply to apology? 17/2/14

The results of the EGM should find comfort that the Dean and the Bishop had been rejected by the members in the affairs of the All Saints’ Cathedral, Kota Kinabalu, Sabah for two reasons:-

The Dean wants to sack the elected Honorary Treasurer for his agenda and the Bishop wants to control ASC and both rejected and so both must go away.

What are we waiting for?

Dear Dean,
Re: EGM on 9th February, 2014 , the unfortunate send off and ex Dean’s Warden

I write to express my displeasure over what had happened at the Extraordinary General Meeting and like to state my position over what had being the real case as you decided to send me off at the end of the main session.

2.             The EGM was supposed to have started with the concept of a family business in a Christian environment as you said in your opening message.  But it turned somewhat awry when you then stated one person can only one questions at each item and that only items in the agenda can be discussed or raised and both instructions are unreasonable.

3.             At the beginning there was a brief management on voting papers for 8 items.  I stressed that all voting papers should be returned at the end stapled together and not in loose ones as one member is one vote each.  Dean then mentioned nobody was going to cheat.  So I ask Dean to tender apology for the word “cheat” which I did not use.  Dean was silent.

4.             I was given some limited chance to raise questions and comments but definitely not adequate for such an important event as Constitution Amendments.  So I did start to raise the issue of legality of this EGM when the Notice of the EGM was not signed by the Secretary and that the Notice did not specify the originator of the EGM as provision of VII Annual General Meeting under clause 8 from Bishop or Dean or request of twenty members.  Such questions/comments were prompted by two recent incidences namely the existing Constitution is illegal for amending the 14 to 21 days in item 1 and the recent High Court’s decision on “non legal entity”.  Then you chose to warn me of the possible send off rather than answering me.  That is not Christian-like family gathering.  I did not come with any grudge but you seemed to have a pre-conceived agenda which was later fulfilled by sending me off for making some good comments.

5.             Now I come to the incident prior to the send off unfortunately with flimsy reasons or excuses.  You did not announce that the counting zone was off limit to authorized persons only and there was no sign –NO Entry - to the place once the chapel.  Before you sent me off, you told the church I was not supposed to be there.  Then the “uniformed person or persons” were almost before me to do your bidding before I could explain to you.  As I was walking out of the chapel, I urged you to appoint some scrutineers for the counting of the votes after my observations.

6.             Now I come to two important elements of displeasure for all.
6.1     The person in charge of the counting namely Wilson –the ex dean warden told me “You are in your mind that there is always cheating and you are cheating”.  That was spoken loudly infront of some young people and I asked him to apologise which he did not.   I then told him there are enough comments of cheating in AGM2012 and AGM2013 in the blogs.  Then I left the place.  I still want a public apology from Wilson and you name the time on Sunday. [NB: I can download those comments in the blogs if you need them].

6.2     You have to give valid reasons why I was sent off without warning and no chance for a reply by me.  Instead you already called the ‘uniformed men’ to be near me to harass me to leave the place when I never refused to go.  You have to justify the use of non church members to provide security within the church event when such uniformed men were supposed to be for the security of the car parks.  That is tantamount to the desecration of the holy church and disrepute to the family gathering – grieving God.  So an apology on Sunday from you and from Wilson is in order for the peace of His church.  Lets have pleasant shake hands.

7.        In conclusion I wish the Constitution be upgraded more extensively and the latest amended Constitution be reviewed by members before it is forwarded to the Bishop.

Thank you,
Yours faithfully,

Joshua Y. C. Kong
