Legal options for members to consider
Members of ADOS, please consider the following
(not exhaustive)
Don’t talk and write and tell others what to do as
Whoever want to implement any thing a process
Of work need to be carried out.
At least those talk and write to others what to do this and
that, show
Us the structure / programme to be feasible with the
expected results.
So I would propose lawyers or otherwise , Christians or
otherwise
If you want to see justice in BISHOPGATE, please
- Please institute a legal suit to review ADOS as a Religious Trust.
- Please do a valuation of the Deanery at ASC for the purpose to
Determine the value of rental for a fully furnished detached
house of two storeys.
Then file a suit to recover the back rental for 6 years for
the abuse of AVCF to allow
Non Dean’s family to stay there. So we can recover a few hundred thousand
Ringgit for
ADOS.
- File an injunction to stop AVCF as Bishop for all those violations known and unknown.
- many more individual and private suits can be instituted and the fund can be set up for such purpose.
So start thinking and it is still not too late to act.

Any plaintiff, please make sure you have proof of locus standi namely a proven member with confirmation certificate, member of some subcommittee; as the church does not list out members attending AGM's minutes.
ReplyDeleteIf members keep their AGM minutes, and if they had done some resolutions, then that is proof of membership.
The church keep the membership list to themselves and does not print one to be distributed to members at AGM.
How many suit would be filed as different plaintiffs may want certain issues possibly personal interests involved.
ReplyDeleteAll my issues are of public interest and nothing personal at all as I never talked to AVCF for more than 5 minutes since 2006.
All those encounters at the several ASC AGMs were unpleasant.
Once any suit or Writ of Summon is filed in the defendants would likely come up with all sort of allegations - relevant or irrelevant.
ReplyDeleteI have seen the modus operandi of the affidavits filed by defendants assisted by Ronny and Stephen who had sort of jointly rewarded with Moral Victory to defend or protect alleged criminals soon to be open in the Court.
So how many here are prepared to come out in the OPEN to be counted to take action or to support any visible action to be commissioned by some people?

Isn’t it a great blessing of God to do what is left to us now to close the BISHOPGATE against AVCF and others?
Those people who had faith in the internal settlement ae very disappointed and likely now blame it on civil suit as the way it had gone. But I do not lose heart as I believe the re-file will open a much bigger phase for success with greater punch.
ReplyDeleteOne thing I don't have is adequate funding as I can claim I have almost 1,000 pages of solid evidence to NAIL AVCF once and for all.
I have consider all the options but I do not want to list them here.
Now we may go for more defendants and would they cooperate with the case and not run away as some have already disappeared for some reasons.
If we look at the 5 complainants and the 10 appellants, I can see it is very difficult for the 15 in individual capacities to bring this case to the Civil Court unless some have changed their minds.
What Charlie Fu wrote is indeed worrying to go with the failure of the ARchbishop?
Why wait when waiting is what AVCF wants to strike the final deal in ADOS to destroy ADOS for personal gains to sustain his style of living high living.
So we need to come now to fight on a higher level in Civil Court getting more new people involved..

Can each of the five declare their interest if they go to Civil Court?
ReplyDeleteWho is the employer in ADOS? Is the AVCF the employer? Is the various Boards of ADOS, the employer? Is the Standing Committee the employer?
So we need to determine that to avoid wrong party and it is less clear cut for any company.
Is the Archbishop the superior of the Diocesan Bishop? How would we reconcile the Archbishop in the context of the HOBs? So can the Archbishop really supervise the Diocesan Bishop without reference to the HOBs? What is the legal status of such system?
Some of the five are also somehow connected to the Standing Committee and the 10 appellants, where conflict of interest can play the whole focus out of proportion.
AVCF knows this hence we really new people outside the 15 to go on the Civil Suit quickly.
I can identify 6 or 7 of the ten are undecided as how to proceed from the Advent letter.
So those who are really serious outside the 15, please offer yourselves to face AVCF and his gang in Civil, Criminal Courts etc..
No more waiting as time is our enemy if we need to resolve BISHOPGATE as quickly as possible.
The road to the Civil Court is wide open and how many dare to step into it, for Christ and his Church so that you do not miss out Christmas forever...

What is LOCUS STANDI?
In law, locus standi means the right to bring an action, to be heard in court, or to address the Court on a matter before it. Locus standi is the ability of a party to demonstrate to the court sufficient connection to and harm from the law or action challenged to support that party’s participation in the case. For example, in the United States, a person cannot bring a suit challenging the constitutionality of a law unless the plaintiff can demonstrate that the plaintiff is (or will be) harmed by the law. Otherwise, the court will rule that the plaintiff “lacks standing” to bring the suit, and will dismiss the case without considering the merits of the claim of unconstitutionality. In order to sue to have a court declare a law unconstitutional, there must be a valid reason for whoever is suing to be there. The party suing must have something to lose in order to sue unless they have automatic standing by action of law.

I wish you all the best if that is the understanding of locus standi and not to be challenged in Court after lodging any Police Report as any one can lodge a Police Report.
Sometimes, the Judge wants a Police Report while it maybe nothing wrong to go straight to the Civil Court but I would prefer if the Police takes action on CBT and the process of removing AVCF is shortened…
So we really have to do a series of Court action etc by various people who speak so much.

The simplest way is for all to stand firmly behind JK and his group since his case is already in the process of going to a trial. Some of you may not like the way JK sometimes talks but it is understandable because he talks the truth about some for giving so many useful opinions but when he says come out and work with me,they fizzles out! Some even poured cold water onto his effort when a mistake was made .Those with knowledge of law should advise Jk through his emails and telephone.No offence to anybody,JK is the bravest and hardest working sheep in ASC and you all now have no choice but to come out and work with him.Unity we stand,divided we fall.JK does not mind to be the ‘bad guy’

Thank God for “As I see it”,
It is not that easy for me and my group to have gone the way it has been. Thank God, I am still a survivor if you know what I mean against AVCF. To be a little David in this BISHOPGATE, it is not easy unless God decides and the shortcomings so far are nothing to be compared with final victory yet to come in the War in ADOS.
So to find out more of my experience please meet me on 1/1/2013 at an appointed place and time to be decided by few of us via email or SMS.
David had few peebles and what we have is enough to ‘kill’ the Goliath.

By the time you take action, it is academic and all is gone.
I know the indepth of the agenda of the Trojan Horse but I cannot write it here.
To refile the case, we need to consider other factors which some of you are thinking but not doing anything.
Where can we get all the team of lawyers to fine tune all aspect when one or two items are good enough.
Stop dreaming, stop talking, start acting because you may not serve the Writ within another year when AVCF goes Sabbatical leave as he is likely away for some months from Feb 2013 or even earlier.
So don't be futile for any delayed action.
Also there is a diverse action as some say no Police...but AVCF and gang use Police in church service.
So who are also posting here?
I also know what happen to the Police in this case.
