185. AVCF to answer for this 'rape' crime in ASC..

 If the rape victim had given birth to a child, the DNA of the child must be taken to prove the real rapist. If a Police Report was not lodged by AVCF as the acting Dean then it is fishy. Joshua

The  allegation of 'RAPE' of a minor in ASC in 2012 should deserve an answer not a denial from AVCF.

It is so serious and if this article can come out in the Daily Express's letter of 19th May, 2013, AVCF must clear the allegation now.

Rape accused marries his victim, 13, so case put off

Kota Kinabalu: A 40-year-old restaurant manager who was charged with raping a 13-year-old girl is now married to the victim, the Sessions Court here heard Monday.
The prosecution must now decide whether to proceed with the case.
Riduan Masmud's counsel Loretto J. Padua told Judge Ummu Kalthom Abd Samad that Riduan and the victim went for a lawful marriage under Syariah Law.
Padua also informed Ummu that Riduan had given all the papers and certificates regarding their marriage to the Investigating Officer of the case.
In the previous mention of the case on May 7, Padua told the court that both Riduan and the girl are in the process of getting married in the Syariah Court.
He said Riduan had submitted an application for permission to marry an underage girl and another application for permission to be in a polygamy relationship.
Riduan's first wife, who was present at the court, said she has accepted the matter as fate.
According to her, they have four children aged between 17 and two years old.
The court heard that the alleged victim had, on April 18, lodged a police report to withdraw the police report against Riduan, which was lodged by her aunt.
In Monday's proceedings, Deputy Public Prosecutor Chow Siang applied for another mention date, saying the case involved public interest and concern of the community.
"At present, for the issue of whether to proceed with the charge or not, we still have no decision yet. "Due to the new development in the case, we need the time to study it and come out with the decision that is fair to everyone," said Chow.
Ummu then set June 6 for mention of the case and reserved July 1-4, this year for trial in the event the prosecution decided to proceed with the case.
Riduan is accused of raping the girl at 10am on Feb 18 this year inside a car parked by the roadside in Jalan Air Terjun Kionsom, Inanam, here.
The offence, under Section 376(1) of the Penal Code, carries a jail term of up to 20 years and whipping, on conviction.
Counsel Mary Lee and Datuk Mariati Robert are holding a watching brief for the Sabah Women's Action Resource Group (Sawo) and Sabah Law Association, respectively.
Meanwhile, in the Magistrate's Court, a 29-year-old man claimed trial to keeping a stolen motorcycle worth RM3,000.
Edi Pani, who was brought before Magistrate Nuruhuda Mohd Yusof, is accused of keeping the stolen machine at 2pm on May 2 at Kg Bakau in Likas, here.
The court set July 1-2 to hear the case and released Edi on a bail of RM3,000 in two local sureties. Inspector Azaman Hamat prosecuted the case.

KOTA KINABALU: The State Welfare Department is pushing for the prosecution to proceed with its case against a 40-year-old married man, Riduan Masmud, who allegedly raped his under 13-year-old girl friend.
Community Development and Consumer Affairs Minister Datuk Jainab Ahmad, in revealing this yesterday, said the department would also seek a court order to have the girl, who was only 12 and-a-half years old when she was allegedly raped, taken from her guardians and placed under its care.
She said the department would also file an injunction at the Syariah Court to scrutinize and nullify the marriage status of the girl with the man, should it find that any ‘syarat’ or requirements not met or had been breached.
“This has become a public interest case and I am of the opinion that it is the duty of the community as a whole and the ministry in particular to protect the girl,” she said to reporters when asked to comment on the issue after closing ‘Image Moulding for Harmonious Family Seminar’ organized by her minister here.
“I have confirmed with the Syariah Court that there was an application from the father to marry his under aged daughter with the accused but we will look into challenging the marriage status. If it is true that the accused had raped the girl before he married her, the law must be upheld.
“I am writing to the court to find out what exactly has transpired, the Sabah Women Action Organization (SAWO) has also requested to meet me on the issue and we will discuss the next course of action,” she added.
Jainab stressed that the ministry took the case seriously as it involved not just the interest of the victim but all other young girls at risk of falling victims to rape.
She added it was important for everyone to make sure the court is careful not to set a bad example in dealing with the case by allowing a grown-up to get away with raping an under-aged girl without being punished just by legally marrying her later.
She said the ministry was very disturbed and greatly concerned that the girl may be subjected to further traumatic experience if she was forced to marry the man who had raped her.
“As a mother, I don’t understand why the father allowed the marriage and withdrew the police report lodged against the accused. After all, the report was lodged by victim’s aunt and not him. This is a very suspicious circumstance.
“The girl must already be traumatized by the rape. Will marrying her off to the man who had raped her solve the problem? No. It will only subject the girl to further mental torture.
“I must stress this is not woman versus man; this is about the welfare and safety of a young girl. We don’t want to set a bad example as if we don’t care. We don’t want him anywhere near her,” she said.
The Session Court on Monday said it would re-examine the rape case against the restaurant manager.
Deputy public prosecutor Chow Siang Kong told the court that the prosecution would study whether to proceed with the case, sparking concern the accused may walk free.
It was learnt that the accused befriended the girl through Facebook before allegedly engaging in a sexual act with her in a car parked by the roadside near Kionsom Waterfall in Inanam, on Feb 18.
Riduan who was charged under Section 376 (1) of the Penal Code for rape is currently released on RM8,000 bail.
Meanwhile, at the function earlier, Jainab said her ministry would continue to emphasise on programmes aimed at strengthening the family institution.
She said the government understood a strong family foundation was vital in order for the country to effectively transform itself and propel forward.
She said the ministry had adopted “Happy Family Programme” since 2009, under which allocations had been channelled to various NGO and religious bodies for implementing family-building activities.
As of end last year, she said 72 such activities had been implemented in Sabah, with 32 more planned for this year.
In addition, she said the ministry also organized various activities under special out-reach programmes for families in remote rural areas.

Kota Kinabalu: State Community Development and Consumer Affairs Minister Datuk Jainab Ahmad Ayid on Saturday appealed to DPP (Deputy Public Prosecutor) to put behind bars without bail the 40-year-old restaurant manager who raped a 13-year-old girl. "God knows what he can do to the 13-year-old. She should be protected.
If his intentions are pure, why didn't he marry her in the first place?
Why did he marry her after he raped her?"
Jainab raised the issue during a press conference held after opening the MBR Carnival at the City Mosque in Likas, here.
"This is statutory rape. He should not be let off the hook just because he married her.
We don't want rapists to get away with their actions just because they got married to the victims. This also reflects a bad image on Islam and Muslims," she added.
She continued to express how grieved she is about the issue and as a woman, a mother and Minister of Community Development and Consumer Affairs, Jainab said she was talking based on facts and not emotions.
"I don't intend to fight with anyone. If there is a loophole, we want to make sure it is not used by criminals to get away with an offence. I just want to protect the child.
If we don't act properly, a lot of children could face the same situation.
How many other children do we want to see suffering?"
Apart from that, she also requested the rapist's employer to terminate his employment contract with immediate effect.
"What would happen if he comes across other young girls at the restaurant where he is working?"
To illustrate more of her disgust, she continued to explain that the 13-year- old girl and the 40-year-old man should not have been allowed to wed. How can the court allow that?
On top of that, she disagreed with the man's lawyer who ordered that no statements about the man should be sent around as it causes him stress.
"Jheains and Jakim should make things right. The Syariah Court should also look into this matter.
"The man is the culprit. He is 40 years old. He knows what he's doing.
We should protect the child. Do the right thing," said Jainab.
Meanwhile, Jainab questioned further the man's intentions.
"He did not show up in court on May 15, then told the court on May 20 that he had already married the girl without polygamy consent. Suka sama suka? There is no such thing as suka sama suka. He is 40 years old."
In relation to this, she said that their first interaction which started on Facebook was based on a lie. "He claimed to be 24 years old and single."
Another act which rose suspicion was the father's application (affidavit), she said.
"His reason for allowing his daughter to get married was due to court case problems which did not make sense.
The second one was due to pity to the man for having a family (a wife and four children). "Pity to the guy?
Why are they not pitying their own child?
If her parents can't take care of her, we will take care of her. He must have threatened the parents or influenced them in some way. They are living in poverty."
Also highlighted by Jainab were her intentions to give proper counselling to the child and her parents.
"If money is the issue, we will help the parents through the Welfare Department and other ways."

  1. Why the crimes in ADOS especially in ASC can be allowed to ‘prosper’?
    What is the use of Anglican Synod when they all turn blind eyes to crimes of AVCF and his gang when the Synod is now aware of the serious crimes?
    What is the use of the Standing Committee when their integrity is questioned knowing that AVCF and his gang had committed crimes using God’s money when it is public fund?
    What is the use of the Parochial Church Council of PCC of ASC when the acting Dean had committed much frauds and crimes in his six years from 2006 to 2012?
    Do the Synod members, the standing Committee members and PCC members fear God or fear mortal man?
    If they really fear God, then they must take appropriate action to put the House of God in good and proper order and not in dismay scenario now for too long. Can they remain silent?
    Most of the clergy and pastors also aware of the crimes of AVCF and his gang? Why they also keep quiet? Is that the way to serve the Almighty God?
    Don’t tell me that these people mentioned above have no conscience and that God allows the crimes to be perpetrated by AVCF and gang without recourse to recovery?
    Show me the Bible verses that protect you to keep silent on such crimes when crimes are crimes.
    Why are the Synod, the standing committee and PCC not work together now to push forward immediate remedial actions to stop the massive crimes in ADOS and likely in all Anglican churches?
    So the obvious conclusion is that the ADOS, the Synod and the Standing Committee are all red herring and should be done away with immediately. We also don’t need a bishop.
    All the clergy can do what the bishop can do the normal duties for the church. We don’t need the bishop to officiate the confirmation of members as any qualified clergy can do that as well as it is the Almighty God who confirm Christians as his disciples.

    This is a true story of a very serious crime.

    Soh See Yee or SSY as some people know him still to be alive but by others assumed names. Dr Lin also knows him.
    SSY always drive different posh and luxurious cars – borrowed, stolen or used without permission – to mislead a senior police officer who had a teenage daughter of 16. SSY had a teenage son 17 and he tried his vanity approach to tempt these two teenagers to be friends and SSY as the driver/father. His vanity approach of using various posh vehicles to bring the teenagers out ended with the young girl pregnant and then a ‘short-gun’ marriage was arranged. You know what actually happened, SSY was the rapist of a minor and SSY put it on his teenage son. That ‘marriage’ was short lived with the burden of an unwanted and unloved child with misery all round. So beware, this kind of crime can be repeated anywhere and anytime. Can you think of one now near and far? Share it if you have one.
