From the Truth blog on Court cases by AVCF

23. July 26, 2012 - 11:15 pm Messenger of Truth
To ‘Samtheprophet’ regarding your message on July 26/2012 at 7:54am on 1Corinthian 6:1-6. God’s Word is God’s Word. The message does not change but it is we humans who turn and twists it around.
God’s Word in 1Corinthian 6:1-6 remains UNCHANGED and is till the TRUTH.
What you are about to read is the HARD TRUTH regarding legal matters on AV and the Plaintiff. These happened BEFORE the Plaintiff goes to the Court to file an injunction against AV. Here is how it goes:-
1. TRUTH NO.1 – AV, through legal firm, Chin Lau Wong & Foo (of which Stephen Foo is a partner) sued the Plaintiff AND the Police regarding the Police Report filed by the Plaintiff on AV and his misdemeanors.
VERDICT: The suit was denied.
2. TRUTH NO.2 – Five non-Sabahan lawyers, through Chin Lau Wong & Foo (AGAIN), working on the AV case and in close tandem with state officials, sued a senior private lawyer and a very senior judge regarding the “workpass” of the Plaintiff’s lawyer BEFORE this lawyer took up the case to represent the plaintiff.
VERDICT: The suit was denied once again.
These are TRUE cases. Check with the legal system and see if these cases are indeed true.
Now, WHO do you think breaks God’s Word? AV or the Plaintiff? You be the Judge.

My comment - is there any transparency?

BISHOPGATE now in High Court

PRESS RELEASE on BISHOPGATE by the Plaintiff

The High Court has awarded a Court Order on 18th July, to the plaintiff of a Writ after an Ex parte
hearing to gather all documents, records of the Anglican Diocese of Sabah ADOS and all
the churches and establishments under the said ADOS for the purpose of scrutiny.

The Court Order with several key conditions has arisen by the Writ of a member and
beneficiary of the Anglican Church in Sabah filed recently with a Certificate of Urgency at
the High Court of Sabah and Sarawak, Kota Kinabalu. The defendants are the Anglican
Bishop of Sabah and the holder Datuk Albert Vun Cheong Fui. The honorable judge was
Tuan Lee Heng Cheong with session held in chambers

The Writ does not involve the Anglican churches in Sabah and normal church activities
can still go on as usual. Members who are concerned and interested to know more should
contact the committee (more details to come) to be set up for this purpose. You may go to
the three websites listed below for further information.

The Writ does not touch on the religious aspect of ADOS  and was served on the Bishop at 2,15pm on 23 July, 2012 at his office in Wisma Anglican.

The Writ or High Court action is a consequence as a part of the process as exposed
in the massive blog since 23 October, 2011 following many unhappy and undesirable
developments surround the defendants since the holder became a Bishop on 25 th April,
2006. The blog is allsaintscathedral.blogspot.com and presently in four titles with
thousands of postings by some known members and many other concerned anonymous
forummers. The other two blogs that had emerged in the Internet are “The Truth” at http://
thetruthasc.wordpress.com and Bishopgate at Bishopgateinanglicansabah,blogspot.com.

The crux of the Writ is about the way the defendant manages the ADOS and some 80
establishments under him including the financial affairs not transparent to the members
and the beneficiaries at large. The Defendant is also the sole trustee of ADOS and his
dealings have been questioned in many situations. This Court case is the first one in
Sabah and compliment the ongoing effort with the ‘Investigation Committee’ of APSEA.

The case by the sole plaintiff is represented by Mr Rakhbir Singh.

NB: The plaintiff wants to remain anonymous for good and valid reasons and no
photography of the plaintiff.
You may contact my learned Counsel for the legal perspective.

OPEN letter to AVCF

OPEN letter to the Anglican Bishop of Sabah cum sole trustee  1st July, 2012
BISHOPGATE – protest against the Celebration  Centre in All Saints’ Cathedral

1.         As a member and a beneficiary of Anglican Church of Sabah especially of All Saints’ Cathedral, I would like to ask the Bishop Datuk Albert Vun Cheong Fui to suspend the Ground breaking ceremony of the Celebration  Centre in All Saints’ Cathedral worth RM30 millions on 24th July, 2012.

2.         Amongst the reasons for this request are the following:-
2.1       The Bishop has yet presented the complete development plan for public preview.
2.2       The Bishop has already incurred a lot of preliminary costs of the said project without accountability since November, 2011 when fund raising was commenced without a permit to raise fund from the public.
2.3       The Bishop has yet to present its statement of accounts since last year indicating how much of receipts and expenditure so far even after the Bishop and as Dean of All Saints’ Cathedral has transferred some money to the said Building Fund possibly unauthorized.
2.4       It is known that ASC needs to raise 60% of the project costs and failing that target within the shortest time, it is likely the project would be stalled and a white elephant in ASC ground.
2.5       It is understood that it is good practice for the church to have at least 50% of the desired sum before the project is to be started.

3.         STOP order
3.1       Unless the terms and conditions in 2 above are met, a stop order is desired.  There is no point to launch the project with ground breaking ceremony.
3.2       The Bishop must now call an EGM for the purpose to consider this STOP order.

4.         Burden for members and beneficiaries of ADOS
In the absence of adequate fund to complete this project, all sorts of problems can arise with the main contractors, the consultants and the authorities and it would be meaningless and costly to dismantle an incomplete concrete building.  Furthermore when such a big contract encounter financial constraints, ADOS would be placed in untenable and precarious  position resulting in the total collapse of Anglican Church in Sabah when ASC could lose its priced and precious land asset in  ASC as any source of finance would demand collateral.  This has happened in  Kota Kinabalu and can happen again when the same ‘players’ are involved...

5.         NOTICE to be heeded
Bishop, please take NOTICE of this STOP order.  You had been removed as acting Dean of ASC by the ASC AGM 2012’s resolution with two third majority and yet you have ignored it.  You are into an illegal project in ASC ground when you did an illegal Kokol Prayers Summit recently.
