Motions for the
ASC AGM 2014 to be held on 13th of April, 2014 as follows:-
- That the present Dean Chak Sen Fen of All Saints’ Cathedral be replaced as soon as possible with a qualified ordained priest with the appropriate ethic of fairness and justice and his term is not to be renewed.
Rational
1.1
Dean
Chak has been exposed in his handling of AGM 2013 in March 2013 where he was
bias and mismanaged the elections of the Parochial Parish Council members so
soon after he was appointed Dean in December
2012.
1.2
Dean
Chak was proven incapable to handle the proceeding of the Extraordinary General
Meeting for various Constitutional
Amendments which were inadequate to address all the key issues for the general
good of the church. While he started the
EGM with an encouragement to treat the event as a family business, but he later
reduced that concept to a restriction for asking more than one question for
each item. He was pre-occupied that
everything for the EGM was alright and not prepared to consider the illegality
of the EGM.
1.3
Dean
Chak did not consider the decorum of the proceeding of the EGM as important.
1.4
Dean
Chak was unreasonable without valid reasons as a shepherd by sending off at the
end of the EGM using questioned “uniformed men” coming to the front pew bringing
disrepute to the Christian family fellowship and broken all the tradition of
ASC and Anglicanism.
1.5
Dean
Chak’s performance (spiritual and otherwise) has been questioned with decline
in attendance of the Sunday congregations and much decline in the revenue of
the Cathedral which are the basis of the judgement of the parishioners.
- That the new Dean of All Saints’ Cathedral should be Rev Moses Chin.
2.1
He
is the most senior priest in Anglican Diocese of Sabah and the Dean of the
Cathedral is an important position.
2.2
He
was a candidate of 4 senior priests for the Bishop of Sabah in 2005.
2.3
We
do not hear of any adverse behaviour from him even after he was striped off the
Archdeaconate recently.
2.4
He
would be the faithful shepherd and a model priest for the clergy to emulate.
2.5
He
had stood his ground as a faithful servant of God in ADOS.

I will try to
translate it into BM and some person translate it to Chinese.
I wish every Anglican would pray for the motions for the ASC AGM to be held on 13th of April, 2014 as follows:-
1. That the present Dean of All Saints’
Cathedral be replaced as soon as possible with a qualified ordained priest with
the appropriate ethic of fairness and justice and his term is not to be
renewed.
- That the new Dean of All Saints’ Cathedral should be Rev Moses Chin.
Rational for
the motions in the same matter of the Dean.
- The present Dean since appointed on 6th of December, 2012 had been given a chance to bring transformation or improvement in ASC but his questioned performance for the AGM 2013 in the process of the elections of the PCC was exposed and as published in the blogs. He was the proxy for the previous predecessor. Also he could not be answering questions for 2012 as he held office for a few days only in 2012.
- I was not allowed to ask many questions in the AGM 2013 and he never answered my written questions but gave me an appointment at very short notice but I still prefer he answered my written questions with written answers.
- At the EGM 2014 held on 9th of February, 2014, his performance had brought disrepute to the long tradition of the ASC for more than a century as follows:-
3.1
As
Chairman, he should clarify why the Notice for the EGM was not signed by the Honorary Secretary, the
Notice did not specify whose requisition for
the EGM was of the three parties namely the Bishop, the Dean or the 20
church members. Also the present Constitution is deemed to be illegal with
first item in the Amendment amending the days from 14 to 21. So on this basis, I did raise the issue of
the illegalities of the present EGM with the missing signature, the status of
the Bishop (with the prerogative power in ASC) with the latest decision of a Court case against
the House of Bishops of Anglican Province of South East Asia as “non legal
entity” when the Bishop of Sabah is appointed by the Archbishop of APSEA
instead of Archbishop of Canterbury.
Instead of answering this clarification, Dean Chak warned me that I
could be sent out of the EGM. At a later
point the Chairman did make a remark for which I asked him to apologise.
3.2
So
in the absence of who had requested the EGM, it is confirmed that the Dean
actually who initiated this EGM after appointing a committee of 5 members (not
20 members requesting such EGM) but
there is a confusion why the Diocesan Chancellor was there to present the items
of the EGM on Constitutional Amendments giving the dubious impression that the
Bishop was behind this EGM. So what is
what ? If it the Dean’s desire for the EGM, then the Dean is held fully
responsible for wanting to dismiss the elected Honorary Treasurer only of the
15 elected members of the PCC as a chosen servant of God as it is deemed that
PCC members were elected by God at any AGM.
I believe this is only body that wants to sack the Treasurer and the
implication of the previous Dean is obvious since 2011.
3.3
Dr
James Chhoa was saying that the Amendments were guided by other Constitutions
in the Dioceses in APSEA and I wonder if the dismissal of the Honorary
Treasurer appears in any of them as it is not in the Constitution of the
Diocese of Sabah and the Constitution of the Anglican Province of SEA. Yet Dean sees it fit to do so, if it is
indeed that the EGM is a requirement of the Dean and not the desire of the
Bishop of Sabah? Is this sacking of the
Honorary Treasurer now feature in all Anglican Diocese? Maybe it is timely to
learn from the model of Constitution of the Society Act as how the Registrar of Society present its
model Constitution to registered bodies and its regulatory practice.
3.4
The
overall decorum of the EGM in session was in disarray largely due to the
behaviour of a sector of the members.
3.5
Opinions
on the purpose and the precision of the Amendments of the Constitution were
expressed by members.
3.5.1
I
did raise that the item 8 did not address the issue of the Bishop cum acting
Dean where a conflict could arise. I
also raised the missing of the important words – days or working days after 7
in item 6 as Hands of God not typographical error.
3.5.2
Rosalind
did raise an issue omitted in the Amendment namely that members of ASC must be
citizens and permanent citizens to regularize and update the Rolls. Without this item in the Constitution and
silence thereof how would the Dean implement this provision? But the Dean did mention at the end he would
update the Rolls to exclude those who had passed away sort of mocking any
suggestion to exclude foreigners on temporary or illegal stay considering
Project IC holders. I want to see the
new Dean to do it properly and that the Rolls must shown the NRIC number of the
members and not telephone numbers (not essential) only.
3.5.3
Finally
the Chairman/ Dean wanted to send me off at the end of the EGM while the ballot
papers were in the process of collection.
The Chairman did not announce that the counting zone was off limit to
unauthorized members and there was no sign at the entrance of the area once the
chapel. Without giving a proper reason
and a proper hearing from me, the
Chairman decided to send me off and the illegal “sort of security guard” in
uniform was already there to force me off after I called on the Chairman to
appoint some scrutineers for the counting process. [what the ex Dean Warden
said at the counting zone is a matter to be dealt with later].
3.5.3.1
We
were told that the sort of security guards were to be outside the church to
look after the car parks after a car was stolen. How come they are also asked to come into the
church to bring total disrepute to the Anglican tradition of a big family and a
big Body of Christ also the Bride of Christ when he comes back for us. What the Dean did finally confirmed he is
unfit to hold the very important office of Dean and also confirmed what he
intended to do to me from the beginning.
He did not come to shake my hands as a shepherd when he shook the hand
of Vincent and Peter who were seated in the row just before me when Dean came
into before the start of the EGM. God is
definitely watching how the Dean behaved miserably and doing the bidding of
someone apart from God.
- Without any prejudice, I thank you for reading such a very long article for this very important matter of all Christians and I hope you would play your role for God and be seconders for these motions and a brief one would be printed when we are ready. Mind you, we have slightly more than two months to do this at the next AGM unless we call another EGM for this to bless all. We only need a simple majority to pass the motions.

This is an early warning ---
If Dean Chak does not respond to my emails and then the official letter, I would move a Resolution in the AGM 2014 of ASC to remove Dean Chak and would appreciate a seconder.
This is for the better of ASC and since he came on end of 2012, he has been a disappointment in 2013 AGM and 2014 EGM yesterday.
AGM 2013 was a mess and it was an election of PCC with gang frauds.
EGM 2014 also in a mess especially with the notice - not signed by the Secretary, and the Order of the EGM was unspecified if it was a Bishop, Dean or 20 members calling the EGM. Item 3 was such a messy thing that much unfortunate exposures were revealing indeed with words like Melayu and chicken paper.
We should treat the EGM as an OPEN exposure session rather than an election to pass the Amendments much in desire of more precise and expanded.
This is the only one organisation in the world that seeks to SACK the elected Honorary Treasurer.
So support my motion to remove the Dean Chak and also block the "illing" and "crooked" bishop as the acting dean. A fresh and qualified Dean must be appointed as soon as possible to bring the Godly order to the ASC.
