303. Resolution to remove Dean Chak


Motions for the ASC AGM 2014 to be held on 13th of April, 2014 as follows:-

  1. That the present Dean Chak Sen Fen of All Saints’ Cathedral be replaced as soon as possible with a qualified ordained priest with the appropriate ethic of fairness and justice and his term is not to be renewed.

Rational

1.1     Dean Chak has been exposed in his handling of AGM 2013 in March 2013 where he was bias and mismanaged the elections of the Parochial Parish Council members so soon after he was appointed Dean in December  2012.
1.2     Dean Chak was proven incapable to handle the proceeding of the Extraordinary General Meeting for various   Constitutional Amendments which were inadequate to address all the key issues for the general good of the church.  While he started the EGM with an encouragement to treat the event as a family business, but he later reduced that concept to a restriction for asking more than one question for each item.  He was pre-occupied that everything for the EGM was alright and not prepared to consider the illegality of the EGM.
1.3     Dean Chak did not consider the decorum of the proceeding of the EGM as important.
1.4     Dean Chak was unreasonable without valid reasons as a shepherd by sending off at the end of the EGM using questioned “uniformed men” coming to the front pew bringing disrepute to the Christian family fellowship and broken all the tradition of ASC and Anglicanism. 
1.5     Dean Chak’s performance (spiritual and otherwise) has been questioned with decline in attendance of the Sunday congregations and much decline in the revenue of the Cathedral which are the basis of the judgement of the parishioners.


  1. That the new Dean of All Saints’ Cathedral should be Rev Moses Chin.

2.1     He is the most senior priest in Anglican Diocese of Sabah and the Dean of the Cathedral is an important position.
2.2     He was a candidate of 4 senior priests for the Bishop of Sabah in 2005.
2.3     We do not hear of any adverse behaviour from him even after he was striped off the Archdeaconate recently.
2.4     He would be the faithful shepherd and a model priest for the clergy to emulate.
2.5     He had stood his ground as a faithful servant of God in ADOS.

I wish every Anglican would pray for the motions for the ASC AGM to be held  on 13th of April, 2014 as follows:-

  1. That the new Dean of All Saints’ Cathedral should be Rev Moses Chin.





Rational for the motions in the same matter of the Dean.



  1. The present Dean since appointed on 6th of December, 2012 had been given a chance to bring transformation or improvement in ASC but his questioned performance for the AGM 2013 in the process of the elections of the PCC was exposed and as published in the blogs.  He was the proxy for the previous predecessor.  Also he could not be answering questions for 2012 as he held office for a few days only in 2012.
  2. I was not allowed to ask many questions in the AGM 2013 and he never answered my written questions but gave me an appointment at very short notice but I still prefer he answered my written questions with written answers.
  3. At the EGM 2014 held on 9th of February, 2014, his performance had brought disrepute to the long tradition of the ASC for more than a century as follows:-



3.1                 As Chairman, he should clarify why the Notice for the EGM  was not signed by the Honorary Secretary, the Notice did not specify whose requisition for  the EGM was of the three parties namely the Bishop, the Dean or the 20 church members. Also the present Constitution is deemed to be illegal with first item in the Amendment amending the days from 14 to 21.  So on this basis, I did raise the issue of the illegalities of the present EGM with the missing signature, the status of the Bishop (with the prerogative power in ASC) with  the latest decision of a Court case against the House of Bishops of Anglican Province of South East Asia as “non legal entity” when the Bishop of Sabah is appointed by the Archbishop of APSEA instead of Archbishop of Canterbury.  Instead of answering this clarification, Dean Chak warned me that I could be sent out of the EGM.  At a later point the Chairman did make a remark for which I asked him to apologise.

3.2                 So in the absence of who had requested the EGM, it is confirmed that the Dean actually who initiated this EGM after appointing a committee of 5 members (not 20 members requesting such  EGM) but there is a confusion why the Diocesan Chancellor was there to present the items of the EGM on Constitutional Amendments giving the dubious impression that the Bishop was behind this EGM.  So what is what ? If it the Dean’s desire for the EGM, then the Dean is held fully responsible for wanting to dismiss the elected Honorary Treasurer only of the 15 elected members of the PCC as a chosen servant of God as it is deemed that PCC members were elected by God at any AGM.  I believe this is only body that wants to sack the Treasurer and the implication of the previous Dean is obvious since 2011.



3.3                 Dr James Chhoa was saying that the Amendments were guided by other Constitutions in the Dioceses in APSEA and I wonder if the dismissal of the Honorary Treasurer appears in any of them as it is not in the Constitution of the Diocese of Sabah and the Constitution of the Anglican Province of SEA.  Yet Dean sees it fit to do so, if it is indeed that the EGM is a requirement of the Dean and not the desire of the Bishop of Sabah?  Is this sacking of the Honorary Treasurer now feature in all Anglican Diocese? Maybe it is timely to learn from the model of Constitution of the Society Act  as how the Registrar of Society present its model Constitution to registered bodies and its regulatory practice.



3.4                 The overall decorum of the EGM in session was in disarray largely due to the behaviour of a sector of the members.



3.5                 Opinions on the purpose and the precision of the Amendments of the Constitution were expressed by members. 



3.5.1            I did raise that the item 8 did not address the issue of the Bishop cum acting Dean where a conflict could arise.  I also raised the missing of the important words – days or working days after 7 in item 6 as Hands of God not typographical error.  

3.5.2            Rosalind did raise an issue omitted in the Amendment namely that members of ASC must be citizens and permanent citizens to regularize and update the Rolls.  Without this item in the Constitution and silence thereof how would the Dean implement this provision?  But the Dean did mention at the end he would update the Rolls to exclude those who had passed away sort of mocking any suggestion to exclude foreigners on temporary or illegal stay considering Project IC holders.  I want to see the new Dean to do it properly and that the Rolls must shown the NRIC number of the members and not telephone numbers (not essential) only.



3.5.3            Finally the Chairman/ Dean wanted to send me off at the end of the EGM while the ballot papers were in the process of collection.  The Chairman did not announce that the counting zone was off limit to unauthorized members and there was no sign at the entrance of the area once the chapel.  Without giving a proper reason and a proper hearing  from me, the Chairman decided to send me off and the illegal “sort of security guard” in uniform was already there to force me off after I called on the Chairman to appoint some scrutineers for the counting process. [what the ex Dean Warden said at the counting zone is a matter to be dealt with later]. 



3.5.3.1        We were told that the sort of security guards were to be outside the church to look after the car parks after a car was stolen.  How come they are also asked to come into the church to bring total disrepute to the Anglican tradition of a big family and a big Body of Christ also the Bride of Christ when he comes back for us.  What the Dean did finally confirmed he is unfit to hold the very important office of Dean and also confirmed what he intended to do to me from the beginning.  He did not come to shake my hands as a shepherd when he shook the hand of Vincent and Peter who were seated in the row just before me when Dean came into before the start of the EGM.  God is definitely watching how the Dean behaved miserably and doing the bidding of someone apart from God.



  1. Without any prejudice, I thank you for reading such a very long article for this very important matter of all Christians and I hope you would play your role for God and be seconders for these motions and a brief one would be printed when we are ready.  Mind you, we have slightly more than two months to do this at the next AGM unless we call another EGM for this to bless all.  We only need a simple majority to pass the motions.

This is an early warning ---

If Dean Chak does not respond to my emails and then the official letter, I would move a Resolution in the AGM 2014 of ASC to remove Dean Chak and would appreciate a seconder.

This is for the better of ASC and since he came on end of  2012, he has been a disappointment in 2013 AGM and 2014 EGM yesterday.

AGM 2013 was a mess and it was an election of PCC with gang frauds.

EGM 2014 also in a mess especially with the notice - not signed by the Secretary, and the Order of the EGM was unspecified if it was a Bishop, Dean or 20 members calling the EGM.  Item 3 was such a messy thing that much unfortunate exposures were revealing indeed with words like Melayu and chicken paper.

We should treat the EGM as an OPEN exposure session rather than an election to pass the Amendments much in desire of more precise and expanded.

This is the only one organisation in the world that seeks to SACK the elected Honorary Treasurer.

So support my motion to remove the Dean Chak and also block the "illing" and "crooked" bishop as the acting dean.  A fresh and qualified Dean must be appointed as soon as possible to bring the Godly order to the ASC.

302. Tense EGM ended with a drama by Dean

Dear Dean,
I am sending you some of the TRUTH in All Saints' Cathedral for your pleasant reading if you care to see that.  The information are extracted from the two universal blogs but not available from the official blogs of ADOS and  website of ASC. 
Who would have to believe that such things are ongoing in ASC and ADOS? 
I have posted this for the benefit of all when the ex Dean Warden alleged me in front of many young Christians at the counting counters in the ASCathedral for the EGM.  The ex Dean Warden alleged that "It is in your mind always that it is cheating".  Then I asked for the apology from him but not given by him.  The cheating as alleged in 2012 and 2013 over voting had been reported in the two blogs and it is not denied and not challenged by ASC and ADOS in the proper channels.
I will write you a detailed signed letter and you still owe me answers for all my questions for AGM2013.  Now AGM2014 is around the corner.
I will also make a comprehensive report on the EGM.

Dear Dean,
I will write you an official letter to obtain the real reason for the kind send off by you as Chairman of EGM at the end of the EGM.
It is very unbecoming that sort of "security guards" were called in as I never refused to leave and no explanation was given.  What has ASC headed to?  Always getting strangers in Church to do some bidding when the needs is not there?  Are we NOT a family in the Body of Christ of humility?

ARE WE EXPECTING CHANGES AFTER ASC 2012 AGM?

With members in full force in a non-election year was interesting to mark a history of the millennium and outcry of our voices must be heard!

ASC’s 2012 AGM lasted longer than 5hours packed with members stayed back with participation eagerly wanted to see an end to the current management structure has been a lack of clarity, all under the manipulation of one man.  Most members expected Bishop Albert Vun appear in person to chair the ASC’s 2012 AGM coming forward for public apologies as how he had conducted himself in the previous AGM. 

Members did not expect Bishop Vun to be silent, absent himself conveniently and deeply buried underground the issues in the blog.  If he thinks he is innocent with the issues raised, the greatest defence was to come forward to explain himself clean and reconcile with the people.  If he truly loves the church, why then he has avoided us?  Why only defended from the pulpit where nobody else can speak to challenge?

The Rector’s self-made rules at the proceeding of the meeting were very much like Bishop’s Vun style not to raise issues on personal attack.  Anyone tried to mention abusiveness of one man's power? Not allowed by the chairman!  How else can you address the issues if you want to say it? We see how manipulative they appear in large meetings like AGM how else can you imagine meetings in the PCC that our voices have always been represented in minority?

Was there a trick to swap the sequence of the 2 resolutions intentionally knowing the first resolutions required 2/3 majority?  The meeting dragged on until 8pm surely some people would have left to attend children at home.

Whether there was integrity in the scrutiny of voting for the 1st resolution of crying out for fairness in the decision making, it is seen rather an obvious manipulation of a “one man show”.  This problem remained unresolved if the elected PCC can never carry a fair voice in the decision making.  We must not let this issue unresolved.  

As for yesterday AGM, I would like to raise the following issues :-
A/.Voting.
1/. Why was last miniutes registration done to
give BM congregation rights to vote ?
We have proof to show one BM lady was in
her possesion 5 circled votes.
2/. Why was the votes for Dr.James Chhoa's
resolution collected twice during AGM.
3/. Why wasn't the votes collected in a more
secured ballot boxes rather then in a open
plastic tray.
4/. Who was assigned to count all these votes
and who witnessed the counting ? Stella
Lo ?
5/. Why wasn't the voting slip given in a
more accountabled maner ? Varify all names
before a voting slip given.My wife was given
2 set of voting slips, why ?
6/. Why wasn't the voting slip numberised ?  







  1. what is the point in voting when after those people left because they had to go home to their children, an announcement was made that those who had left had therefore lost all voting powers?? when the cap was still set based on the original number of people who attended? even this does not make sense to a layperson, but is more than evident of the fraud involved in these practices.
    so shameless done.
  2. Our hloimen /women tried to CHEATS at yesterday AGM by having two booths to register
    BM congregation and thus giving them right to vote.
    ( Learning very fsat from our political masters from West Malaysia ? ).
    My friend had photograhs evidence to proof that a lady had in her 5 voting slip
    circled.
    Our highly spritual leaders tried to CHEAT at any cost, but it is by the Grace of God that the first resolution was passed with more then 2/3 majority. ie 224 vs 120.
    Suprisingly the second resolution has a total of not more then 240 votes and
    balance of 104 votes when missing in action like Bishop Albert Vun Chong Fui ?

    BIG NEWS! Datin Mary Vun (wife of BAV) has been spotted playing dirty politics about voting the 2nd resolution.

    GUESS WHAT? She warned and reminded the BM workers MUST vote against the 2nd resolution. If the 2nd resolution is through, all of the workers will lose their benefits.

    I can't believe my own ears. WHO is trying to cause DIVISIONS to the church now? We have the sincere members wanted to make the system work between the PCC and the priests but the priests think being in control is the way to run the church! How sad to see the wife of a bishop to do such a disgraceful thing! Where is integrity & fairness in voting?






      1. I can testify we casted the votes and passed to those staff with the basket to collect our ballots while Dr James was still talking about his resolutions.

        We trusted those baskets were to collect our ballots for that resolution. Because that was the only resolution.

        Later,we found out those ballots collected earlier were not taken into counting. Why the helpers collected from us and not taken for counting? Baskets of votes left on the table at the entrance of the church.

        They only counted votes collected 2nd time. WHY? People who passed their ballots 1st round to the baskets felt being cheated with great dishonesty from the church leaders why have they instructed their staff to do such a thing?

        Manipulate to win over man's way is of no glory to God. The results for the 2nd resolution is DISQUALIFIED! CANON YONG, YOU GOT IT? YOUR TEAM OF STAFF DID ALL SORT OF DIRTY TACTICS JUST TO WIN. SHAME ON YOU AS A LEADER!
      2. If what was said is the truth, then the only person who was seated at the table that the 1st. collection of ballots collected was our Fake Rev. Philip Lo. He was seated at that table till the very end.
        Now you guys know why, camera was not allowed ?
        It's the dirty hands of Philip Lo or is he going to say the hand of God ?
        Man of no shame.
      3. Anon 2 april o245 ya there were two collection of ballots for the second resolution . The first one was done as soon as the Rector anounced ...now we come to the second resoluion.... three bm staffs came to collect our votes....the second collection was done after the long debate
    1. What,bishop's wife also campaigned? Why must she play dirty and tell lies? Aiyoh,husband and wife really are of the same feather! How can we trust all these so called spiritual leaders? We must keep at them hot on their heels now that we all know we are of one voice,the parishioners have given him 6 years of power and he is abusing it.Everyone wondered why all did not say anything for 6 years and now only came out united but it is never too late.We all have woken up and must work hard to straighten everything.Money saved by our past bishops are now all gone and who gave him the right to draw out the money-again-I am the bishop,I have the right!

      Have you done so ? Can't stand the manner in which our highly educated spiritual Priests, Pastor and even Datin Mary Vun cheated / tried to threaten BM congregation to vote against Dr.James's resolution.
      Shame on you all, especially Datin Mary Vun, the principal of ASA. Parents of ASA
      students, can you trust & imagine what type of education your children are getting from ASA ?



      During the AGM,everything was revealed especially who are on AV's side and who are together with the honourable Dr Chhoa.Those who tried to bring him down are the ones in cahoot with AV.Now out of the mouth of AV's wife telling the BM workers their benefits will be taken away if they did not go against the resolution! This was from the mouth of the tyrant AV's dear wife whom he loves very much, so it is very true that those who work in the church such as the pastors/Priests are all scared to lose their rice bowls.

I think paying the cost to the Court to the defendant without legal identity is itself an illegal order and this item is itself an issue to be dealt with in the appeal. It would be interesting how the appeal would proceed.




Any legal opinion on the impact of the Court case by Fu & Liew if this appeal goes forward within 30 days before 27 February?.  The Court case applied for the release of the Report of the PAC.  So we can vote for the polls but release it only after it is known no appeal is filed with the Appeal Court.  Once released, the "no legal entity" cannot sue - a boomerang of sort.




Can my case against Albert CF Vun be reviewed and refiled now?

It is a very important matter for the Anglican churches in South East Asia.

What is the real meaning of “Non legal entity” for Province of Anglican Churches in South East Asia?

I do not have access to the Court documents of the case of Fu and Liew as Plaintiffs against the House of Bishops of Province of Anglican Churches in South East Asia (APSEA) and the three bishops in the  APSEA including the Archbishop of APSEA.
                                                                                                            
What ‘Non legal entity” means in legal term is that HoB of APSEA is not a corporate body and so what the HoB does is not legal and has no legal status to do anything in the legal context hence it is illegal.

HoB maybe a lose body to manage the four Anglican Dioceses in South East Asia namely Sabah, Sarawak, Singapore and Peninsula Malaysia (Malaya).  Being British colonies, all Bishops are likely corporatized by what we have Certificate of Incorporation under Trustees Incorporation Ordinance (Sabah cap 148).  Each of the four bishops would have their incorporation individually that way.

So it would appear that HOBs of APSEA would not go through such incorporation process for the four dioceses.

So going by the legal understanding, is it right to interpret that whatever done by HoBs of APSEA is illegal as it may be ‘partnership’ of sort but not incorporated.

If whatever done by a non legal entity is illegal hence AVCF is not legal Bishop of Sabah unless it was done by the Archbishop of Canterbury.

So if AVCF was illegal as it was argued by my learned counsel and me, then my case against AVCF should be reviewed in the latest development without the need of Government Proceeding Act 1958 and no wrong party or wrong parties at all.  My locus standi as a member of ADOS by virtue of a member of All Saints’ Cathedral would have succeeded.

What say my learned friends especially those in the legal fraternity.
