329. Support the 3 motion at ASC AGM on 6/4/14

Rejection of my 3 motions in unconstitutional

1.      Who chair the meeting on the 3 motions?

2.      Whether the motions come before the members who are technically the part owners (part builders) of the ASC with Christ and yet only one questioned person has the say.

3.      Look closely with the Cathedral Chapter and the whole affairs of appointing Rev Chak as Dean needs to be investigated.

4.      Whether the 3 motions come before the members at the AGM, God already judged the Acting Dean Vun, Dean Chak in the following key ways:-

4.1 Acting Dean Vun in AGM 2012 as voted out by two third but stayed on to appoint another failed Dean in personal vendetta as proven by emails between them.

4.2  Dean Chak was rejected when the Item 7 of the amendment at  the EGM of 8th February, 2014 failed to be approved.  Deemed a vote of no confidence in Dean.

4.3  Bishop was also rejected in item 8 the amendment at the EGM of 8th February, 2014 failed to be approved.  Deemed a vote of no confidence in Bishop as far as ASC is concerned.

4.4 Now another key Judgement on ASC and ADOS and because of the illegal Synod in 2012 and the auditor was under attack for the management letter and now the missing re-audit accounts of 2010 and 2011, and with that we have no auditor for ASC accounts.  Also this is the direct impact of the manipulated election of PCC members held under Dean Chak in AGM 2013.

4.5 Dean Chak failed to deal with my many questions raised at AGM 2013.

5.  With the rejection of my 3 motions as unconstitutional, Dean Chak has to go.




1.      That the present Dean Chak Sen Fen of All Saints’ Cathedral be replaced as soon as possible with a qualified ordained priest with the appropriate ethic of fairness and justice and his term is not to be renewed.

Some of the rational items are printed already but I am not to repeat them here.

The short term of one year and four months are no excuse for Dean Chak for the performance already evaluated in AGM 2013 and EGM 2014.

It is a deception that it is the Bishop’s prerogative to appoint the dean if only you read the Article XIII Cathedral Chapter of the Constitution of Diocese of Sabah  properly and in the clause 2 “The Dean shall be appointed by the Bishop with the concurrence of the majority of the Cathedral Chapter and shall act as Chairman of the Cathedral Chapter”.

Question here in the selection process for Dean Chak, how many candidates were shortlisted at one and same time?

At the EGM 2014, the rejection of Amendment 7 means no confidence in the Dean Chak and rejection of Amendment 8 means no confidence in the Bishop to meddle in the affairs of ASC as we had enough of him since 2005 till 2012.

We want a Man of God to truly do God’s work in ASC and NOT man of the Bishop to do his bidding making the previous acting Dean still in FULL control in  ASC when the ex acting Dean for his own sins were voted out in AGM 2012 by a big majority.  Even then he took eight months to do enough damage and resigned and replaced by Dean Chak after he had earlier over-stayed his term in dual roles making regular “fictitious” claims that no one was qualified or suitable to be appointed Dean.

We all can feel, see, experience the deep rooted disarray arising from the foot prints of Bishop in Dean Chak.  Why the Budgeted Diocesan Fund of RM300,000 for 2013 was “withdrawn” indicating loss of confidence in Dean Chak?

Dean Chak’s dismal performance is evident by declining revenue and Sunday attendance.  There was still a massive deficit for 2013 if not for the amount received from ASAA of RM120,000 and forced massive cuts in expenditures.      

Since we have totally lost the confidence in the Bishop to administer the ADOS, the Bishop had lost all credibility to have appointed Dean Chak or appoint any future Dean.

ASC belongs to the members and does not belong to the Dean or Bishop, the members should decide that Dean Chak has to go soonest like the previous acting Dean was given the marching order in AGM 2012.  Should Dean Chak resigns now or the vacancy falls vacant, the Bishop Albert cannot be the acting Dean as he had been a violator of all the Constitutions as per PAC reports already made public.










  1. That the new Dean of All Saints’ Cathedral should be Rev Moses Chin.

The All Saints’ Cathedral belongs to all members – past, present and future – hence we are the masters of the ASC and we have the right to choose the Dean given the prevailing deep rotted disarray in ADOS vis-a-vis. 

Rev Moses Chin should be installed as the new Dean immediately.

Article XIII Cathedral Chapter of the Constitution of Diocese of Sabah  properly and in the clause 2 “The Dean shall be appointed by the Bishop with the concurrence of the majority of the Cathedral Chapter and shall act as Chairman of the Cathedral Chapter” can be a RED HERRING as far as Bishop Albert is concerned as the PAC Reports have revealed.

In Bishop Albert’s Affidavit in Opposition dated 30th July, 2012 to my Writ against him, he stated what the Constitution of the Diocese of Sabah in Article VI under section 2(a) that his role is Faith and Order.   Similarly in the Cathedral Chapter the Bishop cannot alone appoint the Dean.

The Internal Auditor could not appointed on the day of AGM 2013 as the auditor should have started its duty from that day.  Till 30th March 2014 when the accounts was presented unaudited, it is the adverse symptom of Dean Chak and his predecessor in another episode of deep rotted disarray.  The numbers of important queries since 2010, 2011 and 2012 reflected that audit work was lacking in compliance with the accounting principles and standards and the ASC Constitutions.

I strongly believe if Rev Moses Chin is installed as New Dean, there would not be problem to get a credible auditor paid or unpaid.

ASC needs a new beginning to put the house in order.

3.  ASC to give its consent/recognizance to enable members of ASC to set up a body under the Society Act 1966 and the Regulations of Societies 1984 of Malaysia (name to be selected later) for the purpose of all members of All Saints’ Cathedral to look after the secular or non spiritual interests of the Cathedral.

We have to find solution to the Anglican crisis which I call BISHOPGATE which must be ended sooner and to rebuild the Anglican fellowship in the Anglican church we need to have a framework within and without the church proper where the clergy (all levels) and laity can meet common interest and that is where an NGO to be formed under the Society Act 1966 and Regulations of Societies 1984.

We start this NGO with ASC. If it is intended to be for the whole Anglican communion in Sabah as a society with many branches and initiated by All Saints’ Cathedral being the mother church, I would call that “ Sabah Anglicans Fellowship Entity” or SAFE an attractive and meaningful name.  If it is only for ASC, then we have to select a name.

We all know that SAFE can do much to revive Anglicanism as we have known it for 100 years except from 2006.  Now we have grown much bigger hence we need SAFE to be safe to conserve Anglicanism.

SAFE can be the natural check and balance for all Anglican churches, the Parochial Church Council, the Standing Committee and the Synod in all the secular affairs of the Anglican system.  We will see how SAFE in its objects would be part and parcel of the Anglican system to enable everyone would be in contributory pose for the greater Anglican design.

SAFE can function like any other NGO in complimentary and sharing role to the Anglican church like making public policies, fund raising, networking, care for members and non members alike in the society at large where the Anglican church has been weak.  The possibilities are endless and also expand God’s kingdom on earth in the least travelled sectors so far.

We have some internal groups but unregistered and only function within the walls of the Anglican church.

SAFE would also be our Face in the community and would become a household name if we make it work efficiently and effectively.

We don’t need the approval of the Bishop for SAFE as the Anglican church belong to all members and I go through the ASC AGM as an appropriate approach or platform for the sake of courtesy and to formalize it  as the seed comes from ASC.
So members are urged to support this motion.

328. Lodge Police Report for CBT and embezzlement

Lets lodge a Police Report and carry an appropriate banner at the Police Station after lodging one or two Police Reports by different persons, but who would be in this high profile case? Let chose twenty amongst us to represent the dissented and not disgruntled.

Truthasc, a great write up but definitely pricking our conscience to act rather than NATO.
Definitely, it is a great sacrifice on your part but the end is yet to come.
It is only the beginning of a new day after this challenge to rise up to the occasion to resolve BISHOPGATE for all in Anglicanism for near and far.

326. Three motions to ASC AGM 6th April,

Too late already for ASC as the AGM is only the 6th April, 2014.
Do we really need to put any resolution is it is already in the Constitution?
The HoB of APSEA is illegal, the Bishop of Sabah is illegal as a sole trustee, the ADOS is illegal because all the rules are violated, the Synod is illegal, the Standcom is also illegal without the presentation of the proper audited accounts, and so why are so many people still quiet? Rise up.

I have submitted 3 motions for ASC AGM and hope they will be tabled at the AGM. Nobody should block the 3 motions.

My dear Anglican brothers and sisters,

Many concerned Christians – Anglicans and others are crying for solution to Anglican crisis or BISHOPGATE as it is the body of Christ.  So the three motions are blessing for us in All Saints’ Cathedral.

Please refer to the Cathedral Chapter in the Anglican Diocese of Sabah on the matters of the Dean of All Saints’ Cathedral.

Don’t be fooled by anyone or others on the appointment of the Dean other than acting Dean.  The once acting Dean AVCF cannot be “sitting/acting” in that post anymore as he was voted out by the AGM 2012 by a clear majority.  [ I am very reluctant to call AVCF bishop as he is proven unfit to hold that post any longer].

Now the deceiving game of AVCF is in Daily Express in the last few weeks although he might have used proxies to fighting a losing war not glorifying God in Christ. I have lodged Police Report against the press articles and letters.  AVCF had declared himself as a winner all the times since childhood.  Now he is reaping what he sows in his socalled ministry for more than 25 years.

With all the blog’s exposure on the PAC Investigation report, what AVCF is trying to salvage his demonic efforts of 25 years to show himself in whatever light would be indeed futile.

So it is timely albeit belatedly to keep ADOS especially All Saints’ Cathedral afloat despite all the dirty linen being washed in public arena. 

My effort to move these three motions is in the right direction to uplift ourselves from the BISHOPGATE, then we can move on. 

By putting a right person as the Dean of All Saints’ Cathedral like Rev Moses Chin, we would have an opportunity to remove the cultic movement of the fall guy AVCF to take root in ADOS like the so often verse in his lips “I am the Bishop” and when queried denials would prevail and other people get the blame for the wrongdoings.

Rational for the motions for the replacement of the Dean Chak with Rev Moses Chin..

  1. The present Dean since appointed on 6th of December, 2012 had been given a chance to bring transformation or improvement in ASC but his questioned performance for the AGM 2013 in the process of the elections of the PCC was exposed and as published in the blogs.  He was the proxy for the previous predecessor.  Also he could not be answering questions for 2012 as he held office for a few days only in 2012.
  2. I was not allowed to ask many questions in the AGM 2013 and he never answered my written questions but gave me an appointment at very short notice but I still prefer he answered my written questions with written answers.
  3. At the EGM 2014 held on 9th of February, 2014, his performance had brought disrepute to the long tradition of the ASC for more than a century as follows:-

3.1                 As Chairman, he should clarify why the Notice for the EGM  was not signed by the Honorary Secretary, the Notice did not specify whose requisition for  the EGM was of the three parties namely the Bishop, the Dean or the 20 church members. Also the present Constitution is deemed to be illegal with first item in the Amendment amending the days from 14 to 21.  So on this basis, I did raise the issue of the illegalities of the present EGM with the missing signature, the status of the Bishop (with the prerogative power in ASC) with  the latest decision of a Court case against the House of Bishops of Anglican Province of South East Asia as “non legal entity” when the Bishop of Sabah is appointed by the Archbishop of APSEA instead of Archbishop of Canterbury.  Instead of answering this clarification, Dean Chak warned me that I could be sent out of the EGM.  At a later point the Chairman did make a remark for which I asked him to apologise.
3.2                 So in the absence of who had requested the EGM, it is confirmed that the Dean actually who initiated this EGM after appointing a committee of 5 members (not 20 members requesting such  EGM) but there is a confusion why the Diocesan Chancellor was there to present the items of the EGM on Constitutional Amendments giving the dubious impression that the Bishop was behind this EGM.  So what is what ? If it the Dean’s desire for the EGM, then the Dean is held fully responsible for wanting to dismiss the elected Honorary Treasurer only of the 15 elected members of the PCC as a chosen servant of God as it is deemed that PCC members were elected by God at any AGM.  I believe this is only body that wants to sack the Treasurer and the implication of the previous Dean is obvious since 2011.

3.3                 Dr James Chhoa was saying that the Amendments were guided by other Constitutions in the Dioceses in APSEA and I wonder if the dismissal of the Honorary Treasurer appears in any of them as it is not in the Constitution of the Diocese of Sabah and the Constitution of the Anglican Province of SEA.  Yet Dean sees it fit to do so, if it is indeed that the EGM is a requirement of the Dean and not the desire of the Bishop of Sabah?  Is this sacking of the Honorary Treasurer now feature in all Anglican Diocese? Maybe it is timely to learn from the model of Constitution of the Society Act  as how the Registrar of Society present its model Constitution to registered bodies and its regulatory practice.

3.4                 The overall decorum of the EGM in session was in disarray largely due to the behaviour of a sector of the members.

3.5                 Opinions on the purpose and the precision of the Amendments of the Constitution were expressed by members. 

3.5.1            I did raise that the item 8 did not address the issue of the Bishop cum acting Dean where a conflict could arise.  I also raised the missing of the important words – days or working days after 7 in item 6 as Hands of God not typographical error.  
3.5.2            Rosalind did raise an issue omitted in the Amendment namely that members of ASC must be citizens and permanent citizens to regularize and update the Rolls.  Without this item in the Constitution and silence thereof how would the Dean implement this provision?  But the Dean did mention at the end he would update the Rolls to exclude those who had passed away sort of mocking any suggestion to exclude foreigners on temporary or illegal stay considering Project IC holders.  I want to see the new Dean to do it properly and that the Rolls must shown the NRIC number of the members and not telephone numbers (not essential) only.

3.5.3            Finally the Chairman/ Dean wanted to send me off at the end of the EGM while the ballot papers were in the process of collection.  The Chairman did not announce that the counting zone was off limit to unauthorized members and there was no sign at the entrance of the area once the chapel.  Without giving a proper reason and a proper hearing  from me, the Chairman decided to send me off and the illegal “sort of security guard” in uniform was already there to force me off after I called on the Chairman to appoint some scrutineers for the counting process. [what the ex Dean Warden Wilson said at the counting zone is a matter to be dealt with later]. 

3.5.3.1        We were told that the sort of security guards were to be outside the church to look after the car parks after a car was stolen.  How come they are also asked to come into the church to bring total disrepute to the Anglican tradition of a big family and a big Body of Christ also the Bride of Christ when he comes back for us.  What the Dean did finally confirmed he is unfit to hold the very important office of Dean and also confirmed what he intended to do to me from the beginning.  He did not come to shake my hands as a shepherd when he shook the hand of Vincent and Peter who were seated in the row just before me when Dean came into before the start of the EGM.  God is definitely watching how the Dean behaved miserably and doing the bidding of someone apart from God.

Rational

1.1     Dean Chak has been exposed in his handling of AGM 2013 in March 2013 where he was bias and mismanaged the elections of the Parochial Parish Council members so soon after he was appointed Dean in December  2012.
1.2     Dean Chak was proven incapable to handle the proceeding of the Extraordinary General Meeting for various   Constitutional Amendments which were inadequate to address all the key issues for the general good of the church.  While he started the EGM with an encouragement to treat the event as a family business, but he later reduced that concept to a restriction for asking more than one question for each item.  He was pre-occupied that everything for the EGM was alright and not prepared to consider the illegality of the EGM.
1.3     Dean Chak did not consider the decorum of the proceeding of the EGM as important.
1.4     Dean Chak was unreasonable without valid reasons as a shepherd by sending off at the end of the EGM using questioned “uniformed men” coming to the front pew bringing disrepute to the Christian family fellowship and broken all the tradition of ASC and Anglicanism. 
1.5     Dean Chak’s performance has been questioned with decline in attendance of the Sunday congregations and much decline in the revenue of the Cathedral which are the  basis of the judgement of the parishioners.

325. New NGO for ASC?

Senior priest,
I had proposed in 2012 for a Sabah Anglican Fellowship Entity or SAFE for this NGO and register it under ROS.
About the Ecclesiastical Court, how to find the Judges if the HoBs are all disqualified to have favoured AVCF to condone his crimes aplenty? Who would be qualified to sit in EC of APSEA? So think about it if it is any good to conduct the very expensive EC when the civil court/corruption/criminal court is the best.
If you want a Bible verse – it is 1Corinthians 5:12-13. Get rid of the ‘rotten’ monster from ADOS and APSEA.







The Police Report against AVCF for perjury and all other related crimes in ADOS is ready.

If you want some verses from the Bible, I can give you two verse to strengthen your spirit.  We are told that God would deal with Bishop but this two verses should encourage otherwise.

1 Corinthians 5:12  What business is it of mine to judge those outside the church? Are you not to judge those inside?  13. God will judge those outside . Expel the wicked man from among you.


The Police Report is back up be most than 50 pages of support, and wish you are part of that.

Baiscally, it would identify the modus operandi of AVCF’s crimes through some items of the 38 items of the PAC Report plus the Court document of my case against Bishop of Sabah and the Article “Bishop under Probe” in Daily Express of 17 July, 2012, the reply to Daily Express by the non legal identity “Diocese of Sabah” asking to apology over false report on “Bishop under Probe” and then Article “Suit against Anglican Bishop Dismissed” in Daily Express of 6th March, 2014 and the letter to the Editor to Daily Express titled “Church members divided over stand of Anglican Archbishop” of 16th March, 2014  where unusually and strangly “ However, the State Secretary following the formations of Malaysia have all been Muslims”  and why “Muslims” brought into Court Case against Bishop of Sabah? Someone picking non issues with me???

You cannot be divided over the Police Report as Archbishop is also in favour of the Court case which ruled APSEA as non legal entity – a wonderful term.

So make time next week to go to the Police Station for my lodgement of Police Report.

Congratulations,
This is not washing dirty linen in the public and if we want a verse to help us please read 1Corinthians5:12 &13 and finish off AVCF . BTW, please confirm if what is published has been edited by you or the one who gave you this PAC report. If it has been edited consciously, it can defeat the whole exercise. Why worry about the Bishops to sure when they are either illegal and non legal identity? AVCF is a rotten and illegal trustee with all the crimes in ADOS and beyond. Hob of APSEA is non legal entity. So the Public Court reigns supreme to resolve BISHOPGATE.

avcf is still the same person when he was a kid as he preached that he never lost in his childhood hence his winning strategy then and now is the same by counter lying and blaming the opponents which he is still doing it and recently he made use of S Foo to launch a rubbish article in Daily Express hoping that he would win again and again the most dirty ways.

In a labour case, who is AVCF?  Is he the boss?  Is he the employer?  Is avcf also a servant?  When we take him to the industrial court, he will say he is the bishop only doing spiritual duty and the employer is Synod or ADOS or Standcom.  He is the biggest liar, sociopath, mental patient like he did in his Affidavit against me.  Similar , HOB of APSEA also behave similarly making itself an "non legal identity".  UK's cases would be irrelevant.  so ponder now.

I am wondering if Pastor Sonia is a Sarawakian and in need of work permit to qualify her for her work here in Sabah ? Does she have pr in Sabah? while avcf want to review and upgrade the Rolls, avcf should also look into the legibility of all priests and pastors including work permit and project IC, which can cause a lot of problems for ADOS.

320. Press releases



 
Claims made in report were false
With reference to the Daily Express report “Bishop Under Probe”
(17 June, 2012), the Diocese of Sabah wish to state that the
 report contained false, unfounded and malicious allegations
 which are highly defamatory in nature.

The Diocese of Sabah has demanded  that Daily Express
withdraw all the above false allegations unconditionally and
 publish a public apology to the Bishop of Sabah.

The Diocese of Sabah also assures its parishioners not to
be drawn into the allegations. All facts and reports concerning
 the ministry and development of the diocese will be given
at the Diocesan Synod as is our practice.

We maintain proper order in the church and there are
 proper platforms to discuss church matters and to make
 decisions for the good and growth of our church.

We regret that our parishioners are distressed and concerned
over the news report.  However, we advise all parishioners
 to seek clarifications  from the Diocesan standing Committee
 should there be a need to.

Meanwhile, we must move on in positive faith.  We must stand
united and strong.  We must maintain our focused commitment
 to reach our church’s  vision.

Diocese of Sabah  (DE letters forum of 21/7/12)

The Daily Express has received a letter of demand from the
Diocese of Sabah and is seeking legal advice. In the meantime,
 it does not concede that the report was defamatory. – Ed.

Joshua’s comment is that “Diocese of Sabah” is not a legal entity according ‘Affividavit’ of the Bishop of Sabah in my Court case against him hence cannot demand apology and the Item  in the press signed of as “Diocese of Sabah” is also questionable.  Why not put the name of the person writing and submitting that item –“Claim made in report were false”  What is Bishop of Sabah hiding?

Going by what Joyce has been sharing on avcf, it is to be confirmed that Avcf is not actually treating the widow sonia the wife of the Dais because he was reported to John C and his fear of being punished by any of his superior.  Actually the fact that he was not made the Archbishop of APSEA and instead Bolly Lapok –somehow his junior took the place instead – had hurt the vindictive man in Avcf.  After this, why should he treated a ‘foreign’ woman so well and so well that it is beyond belief that such a ‘low’ ranking person could be given the responsibility of pasturing a huge church in Sulaman Anglican Church.  Sulaman A Church is an extra church and a drain on the church resources.



We all know what a man wants generally especially Avcf is determined to get what he wants at all costs and he is using others people money or God’s money to satisfy himself.

Like it is alleged that donation and church funds are used to pay off his medical fees without sighting of the full medical reports by Dr Kong Wai Loong of Paragon MC and yet it is alleged that Rev Dais Rukuman had to pay for his own surgery fees.  So Avcf wanted people to pay for the medical fees and he got it done.  So what else he is not capable of as he even lied in the Court’s Affidavit against me.



Actually, you could have seen the trend of Avcf since 2005 till recently of his behaviour towards some women and you can form your own opinion and not hearsay as exposed in the blogs.  What can women offer him whilst others cannot offer him?



Avcf also got the Stephen Foo to reply the press article “Bishop under Probe” of 17th July, 2012 and that reply was miserable and yet Foo dared to challenge the Chief Editor of Daily Express to apologise which I believed was not forthcoming and yet Foo did not file any suit against the newspaper.  So Bishop of Sabah was guilty by that count of circumstances.



On 6th March, 2014 Avcf again managed to get Stephen Foo to make himself a “fool” by writing an article of inconsistencies. misrepresentations and defamation bringing with it the great disrepute to the Anglicism and Christianity in South East Asia and beyond.



So beware Avcf is a man of unsound mind, physical malfunction, and of endless possibilities of crimes and crimes against humanity as he has no respect for most people even his superiors.

Re: Article titled “Suit against Anglican Bishop dismissed” of DE 6th March, 2014 p9



START OF PRESS RELEASE



I would like to lodge my personal protest over the inaccuracies/misrepresentation and defamatory insinuations in the above article.



The defamatory insinuations and statements as published may or may not refer to the Diocesan Chancellor Datuk Stephen Foo as the article started with “Datuk Stephen Foo refused to comment on the legal case brought by some disgruntled Anglican parishioners against the Sabah Anglican Bishop, when asked by Daily Express.  The question of confusion is that if Foo refused to comment, then where did the defamatory words “some disgruntled” come about?  Did the Daily Express with unnamed writer coin such words?  Also who made the mistake both in the heading and the quoted sentence when it was the Archbishop Bolly Lapok as one of the defendants and not Sabah Anglican Bishop?  Then the confusion to the readers could link me to be disgruntled as my name appears toward the last portion of the article.  When was I a disgruntled parishioner?



Surprisingly very naughty and even seditious in the context of Christianity to suggest that statement later and I quote “Christians should not resort to legal action as stated in the Bible.  A lot of accusations as published were hearsay” and was this statement made by Foo or Daily Express or an unspecified person?  If accusations as published were hearsay, surely there is a recourse to punish such activities otherwise whoever had said this is guilty beyond doubt.



Further salt to injury against parishioners was added by Foo when he was reported “The freedom of speech includes the freedom not to say or publish anything.” In this misplaced statement of Foo, I would like to remind him of his response to the Daily Express’s article “Bishop under probe” dated 12 July, 2012 page 2 indicating several items of Criminal Breach of Trust and his subsequent response as published in the letters forum in Daily Express of 22nd July, 2012 in which he acknowledged the unnamed Bishop was an Anglican Bishop and that he mulled litigation against that article, after the Roman Catholic Church had disclaimed that their bishop was not under probe.   Did Foo initiate any litigation process against that article?  If not why not?  Christians should not have short memory.



I am not to dwell into the recent case by two plaintiffs against the House of Bishops of the Anglican Province of churches in South East Asia (APSEA) as I am unsure of the issues raised in those Court documents.  What I know is that there is full Judgement by the High Court Judicial Commissioner Azhahari Kamali Bin Ramli after adjournments during the final process and including some changes in the trial Judge.  The case was started on  August 30, 2013 and the Judgement came about on 29th January, 2014 after several hearings in chamber on 3rd December, 2013, 17th December, 2013 and final  decision was supposed to be on 24th January with VC in open court but again postponed to 29th January, 2014 in Chamber of the Judge for the full Judgement against the Plaintiffs on the “non legal entity” of APSEA with a possibility of Appeal of 30 days thereof with costs of RM15,000 to the defendant.   



As my name was mentioned in the sixth paragraph from the end of the said article, some professionals and readers maybe confused why my case was also included when the Judge on APSEA case as reported that “On this ground (non legal entity) alone I am of the opinion that the Plaintiff’s application should be dismissed and I so order.”  The said article seems so happy to add on the terms “Res Judicata” and “Estoppel”.  Was this in the Judgement of the honourable High Court Judicial Commissioner Azhahari?  I hope Daily Express can publish the full Judgement please. 



As far as my case is concerned started in late June 2012 with an Exparte hearing on for an Order on Anton Pillar in mid July by High Court Judicial Commissioner Lee Heng Cheong (transferred later) to obtain documents for the Anglican Diocese of Sabah and ended in mid December, 2012 and widely reported in the press initially without my name and then my name was revealed in the press to show courage and not cheap publicity.  In this article of 6th March, 2014, why should my name be brought in when there was no full Judgement as the full trial did not take place except arguments on technicalities such as locus standi and wrong party.  So how is it that the legal principle of Res Judicata comes into play with the case against APSEA?  The bulk of my legal documents presented in Writ of Summons and several bulky Affidavits and supporting documents to the High Court were just ignored by the defendants..



I wonder why DE did not refer the matters to C Fu and I prior to the publication of the article to get a balanced disposition to the enlightened readers of all faiths.    The article as it is does give a picture of “contamination” of some “disgruntled” Christians when the undesirable words used like “disgruntled”, “freedom of speech”, “accusations” and “hearsay” need to be defined in the proper perspective for true justice as such words are regularly in the lips of the bishop both from the pulpit and official bulletins of the Church to which parishioners have no avenue to reply.



I hope your paper would publish this letter/press release/article in FULL to clear the air of sort of deception and contamination by the yeast coming from some quarters.
